REFUND POLICY
INTRODUCTION
This refund policy sets out the conditions under which MOURIR D'AMOUR® (hereinafter “we”) will refund products and/or services purchased on the MOURIDAMOUR.COM website, accessible at https://www.mourirdamour.com/ (hereinafter “the Website”).
This refund policy is an integral part of our General Terms and Conditions of Sale and complies with the legal provisions in force, in particular those relating to the consumer's right of withdrawal.
1. RIGHT OF WITHDRAWAL
1.1 Withdrawal period
In accordance with the legislation in force, if you are a consumer, you have a period of fourteen (14) calendar days from receipt of the product or subscription to the service to exercise your right of withdrawal, without having to justify your reasons or pay any penalties.
In the case of an order for several products delivered separately, the period starts from the date of receipt of the last product.
1.2 Exceptions to the right of withdrawal
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts:
- For the provision of services fully performed before the end of the withdrawal period and whose performance began after the consumer's prior express agreement and express waiver of their right of withdrawal
- For the supply of goods made to the consumer's specifications or clearly personalized
- For the supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection (underwear, swimwear, pierced jewelry)
1.3 How to exercise your right of withdrawal
To exercise your right of withdrawal, you must notify us of your decision to withdraw by means of an unambiguous statement before the 14-day withdrawal period expires.

Your statement of withdrawal must clearly state your name, address, order number, and the products concerned.
1.4 Returning products
If you exercise your right of withdrawal, you must return the products concerned to us without undue delay and, at the latest, within fourteen (14) days of notifying us of your decision to withdraw. The
The products must be returned in their original condition, complete (packaging, accessories, instructions, etc.), suitable for resale, and accompanied by a copy of the purchase invoice.

We reserve the right to refuse returned products that have been damaged by handling beyond what is necessary to assess their nature, characteristics, and proper functioning. In the event of depreciation, a discount may be applied to the refund amount.
1.5 Refund
We will issue a refund within a maximum of fourteen (14) days from the date on which we are informed of your decision to withdraw.
However, we may defer the refund until we have received the returned products or until you have provided proof of shipment of the products, whichever is earlier.
The refund will be made using the same payment method you used for the initial transaction, unless you expressly agree to a different method. This refund will not incur any costs for you.
The refund covers the price of the product(s) purchased and standard delivery costs (any additional costs associated with an express delivery method chosen by you will remain your responsibility).
2. LEGAL WARRANTIES
2.1 Legal warranty of conformity
Regardless of the right of withdrawal, you benefit from the legal warranty of conformity provided for in Articles L217-4 et seq. of the Consumer Code, which allows you to obtain, in the event of a lack of conformity of a product:
- Repair or replacement of the product (whichever is possible and least costly)
- Or, if repair or replacement proves impossible or cannot be carried out within one month, a full or partial refund of the price of the product
For goods purchased new, this warranty is valid for two (2) years from the date of delivery of the product. For second-hand goods, this warranty is valid for six (6) months from the date of delivery of the product.
2.2 Warranty against hidden defects
You also benefit from the legal warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code, which allows you to obtain, in the event of a hidden defect in a product, either a refund of the price against return of the product, or a price reduction if you wish to keep the product.
This warranty is valid for two (2) years from the discovery of the defect.
2.3 Implementation of legal warranties
To implement these warranties, you must contact us at contact@mourirdamour.com, specifying your request and attaching any relevant supporting documents (photos, description of the defect, etc.).
Depending on the situation, we may ask you to return the product to us for inspection. If your request is justified, we will, at your discretion and depending on the possibilities, repair, replace, or refund the product as soon as possible.
3. REFUND POLICY FOR DEFECTIVE OR DAMAGED PRODUCTS
If you receive a defective or damaged product, please contact us within 3 days of receiving the package, providing us with:
- Your order number
- A detailed description of the problem
- Photos clearly showing the defect or damage
After verification, we may, depending on the case:
- Send you a replacement product
- Proceed with a full refund of the product (purchase price and delivery costs)
- Offer you a discount on the price of the product if you wish to keep it despite the defect
We will cover the return shipping costs for defective or damaged products. We will provide you with the procedure to follow for the return.
4. REFUND POLICY FOR UNDELIVERED OR INCORRECT DELIVERIES
4.1 Undelivered products
If you have not received your order within the specified time frame (taking into account the delivery times indicated when ordering), please contact us at contact@mourirdamour.com, specifying your order number.
After checking the status of your order and confirming that it has indeed been lost or not delivered, we will either issue a full refund (product price and delivery costs) or send a new order, depending on your preference.
4.2 Incorrect delivery
If you have received products that are different from those ordered, please contact us within 3 days of receiving the package, providing us with:
- Your order number
- A list of the products received in error
- Photos of the products received
After verification, we will arrange for the incorrect products to be collected and the correct products to be sent, or we will issue a full refund for your order, depending on your choice.
5. REFUND POLICY FOR SERVICES
This section does not apply, as our store only sells physical products.
6. REFUND TIMES AND METHODS
All refunds will be made within a maximum of 14 working days from the validation of your refund request.
Refunds will be made using the same payment method used for your initial purchase, unless you agree otherwise. For credit card payments, the refund will be credited to the card used for the purchase.
7. SPECIAL CASES AND LIMITATIONS
7.1 Sale or promotional items
Products purchased during sales or promotions are covered by the same guarantees and withdrawal rights as other products, unless explicitly stated otherwise at the time of purchase.
7.2 Gift cards and store credit
Gift cards and store credit are not refundable in cash, unless required by law.
7.3 Additional costs
Please note that:
- Express or specific delivery costs are only refundable in the event of a product defect or hidden defect
- Any customs duties or import taxes are not refundable by us
