GENERAL TERMS AND CONDITIONS OF SALE
PREAMBLE
These general terms and conditions of sale (hereinafter “GTC”) apply to all sales of products and/or services made on the MOURIRDAMOUR.COM website (hereinafter “the Website”), operated by Eve MEDER for MOURIR D'AMOUR®, whose registered office is located at 2 rue de Lampertheim in Vendenheim (67550), registered in the Strasbourg Trade and Companies Register under number 943 533 117 00017 (hereinafter “the Seller”).
Any order placed on the Site implies full and complete acceptance of these GTC by the customer (hereinafter “the Customer”). These GTC prevail over any other document.
ARTICLE 1 - PRODUCTS AND SERVICES
1.1 Characteristics of products/services
The products and services offered for sale are those appearing on the Website on the day the Customer consults it. The essential characteristics of the products/services are described and presented as accurately as possible.
1.2 Availability
Product offers and prices are valid as long as they are visible on the Website, while stocks last. If a product is unavailable after an order has been placed, the Customer will be informed by email as soon as possible and will have the option of either a refund or an exchange.
ARTICLE 2 - PRICES
2.1 Sales prices
The prices of products/services are indicated in euros or dollars and include all applicable taxes. Any change in the VAT rate will be reflected in the price of the products/services.
2.2 Price changes
The Seller reserves the right to change its prices at any time, on the understanding that products/services will be invoiced on the basis of the prices in force at the time of order confirmation.
ARTICLE 3 - ORDERING
3.1 Steps for concluding the contract
To place an order, the Customer must follow these steps:
- Select products/services
- Check the order details
- Correct any errors
- Confirm the order
- Accept the T&Cs
- Pay for the order
The Customer will then receive an order confirmation by email.
3.2 Order changes
Any changes to the order made by the Customer after confirmation of their order are subject to the Seller's acceptance.
ARTICLE 4 - PAYMENT
4.1 Payment methods
Payment can only be made by card (Visa, Mastercard, American Express, UnionPay).
4.2 Payment security
The security of your transactions is our top priority. To ensure simple, fast, and completely secure payment, our online store uses Stripe, one of the most reliable and recognized payment solutions in the world.
Your banking information is encrypted, never stored on our site, and protected according to international PCI-DSS standards. Enhanced 3D Secure authentication also ensures that you are the only one who can validate your purchase.
4.3 Default of payment
The Seller reserves the right to refuse to make a delivery or to honor an order from a Customer who has not paid for a previous order in full or in part or with whom a payment dispute is ongoing.
ARTICLE 5 - DELIVERY (for physical products)
5.1 Delivery area
Products are delivered to the address specified by the Customer when placing the order. Delivery is available in the following areas: mainland France, Belgium, Switzerland, and Germany.
5.2 Delivery time
Delivery times are 5-7 business days (in France) and 8-10 business days (in Belgium, Switzerland, Germany) from the date the order is confirmed. These delivery times are provided for informational purposes only.
5.3 Late delivery
The delivery times indicated when ordering are provided for information purposes only and correspond to the average times announced by the carriers. In any event, the products will be delivered within a maximum of 30 days after confirmation of the order.
The Seller remains fully responsible for the proper execution of the delivery, even when it is carried out by a third-party carrier, in accordance with Article L221-15 of the French Consumer Code.
5.4 Checking the order upon delivery
The Customer is required to check the condition of the products delivered. Any anomalies noted (missing product, damaged package, broken product, etc.) must be indicated on the delivery note and reported to the Seller within 3 days of receipt.
ARTICLE 6 - RIGHT OF WITHDRAWAL
6.1 Withdrawal period
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify their reasons or pay any penalties. Return costs are the responsibility of the customer.
6.2 Exceptions to the right of withdrawal
The right of withdrawal does not apply to items:
- returned incomplete, damaged, soiled, or worn,
- that cannot be returned for hygiene reasons (e.g., underwear) when the packaging has been opened.
6.3 How to exercise the right of withdrawal
To exercise this right, the Customer must notify the Seller of their decision to withdraw in writing (email or letter), clearly stating their wish to withdraw. A standard form is available on request.
6.4 Refund
The products must be returned to the Seller within 14 days of notification of the decision to withdraw. The Seller will refund all sums paid by the Customer, including the initial delivery costs corresponding to the standard delivery method, no later than 14 days after notification of withdrawal. The Seller may defer the refund until the products have been recovered or until the Customer provides proof of shipment of the said products, whichever occurs first.
The refund will be made using the same means of payment as that used for the order, unless the Customer expressly agrees to another means.
ARTICLE 7 - WARRANTIES
7.1 Legal warranty of conformity and warranty against hidden defects
All products supplied by the Seller are covered by the legal warranty of conformity (Articles L. 217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
7.2 Implementation of warranties
To implement these warranties, the Customer must contact the Seller at the following address: contact@mourirdamour.com.
ARTICLE 8 - LIABILITY
8.1 Exemption from liability
The Seller shall not be held liable in the following cases:
- Non-performance or poor performance of the contract due to the Customer
- Force majeure
- Unforeseeable and insurmountable event caused by a third party to the contract
8.2 Limitation of liability clause
The Seller shall not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, service interruption, or other unintentional problems.
ARTICLE 9 - INTELLECTUAL PROPERTY
All elements of the Website (text, comments, illustrations, images, etc.) are protected by copyright, trademarks, or patents. Any total or partial reproduction of the Website is strictly prohibited.
ARTICLE 10 - PERSONAL DATA
10.1 Data collection and processing
In connection with the sale of products and services, the Seller collects personal data concerning the Customer. This data is processed electronically and stored in the Seller's customer database. The processing of information communicated via the Website complies with legal requirements regarding the protection of personal data, as the information system used ensures optimal protection of this data.
10.2 Purpose of data processing
Data is collected for the following purposes:
- Order processing and management: recording, preparing, shipping, and tracking orders.
- Customer relationship management: after-sales service, returns, refunds, requests for information, assistance.
- Customer account management: creation, login, updating information, order history.
- Order payment: management and security of payments via our payment provider Stripe.
- Fraud prevention and website security: prevention and detection of fraudulent payments or suspicious activity.
- Sending commercial and marketing information (if consent is given): newsletters, promotional offers, new products.
- Personalization of the user experience: product recommendations, personalized display, browsing preferences.

10.3 Customer Rights

ARTICLE 11 - DISPUTE RESOLUTION
11.1 Mediation
In the event of a dispute, the Customer must first contact the Seller's customer service department at the following address: contact@mourirdamour.com
If the complaint to customer service is unsuccessful, the Customer may submit the dispute to a mediator who will attempt, independently and impartially, to bring the parties together to reach an amicable solution.
11.2 Competent jurisdiction
In the absence of an amicable agreement, the dispute will be submitted to the competent courts under the conditions of common law.
ARTICLE 12 - APPLICABLE LAW
These T&Cs are subject to French law.
ARTICLE 13 - PRE-CONTRACTUAL INFORMATION - CUSTOMER ACCEPTANCE
The Customer acknowledges having received, prior to placing their order, in a legible and comprehensible manner, these GTC and all the information listed in Article L. 221-5 of the French Consumer Code.
By placing an order, the Customer declares that they have read and accepted these GTC in their entirety without reservation.
